PLANNING
The bungalow was built in 1969 under a detailed consent granted by Kidderminster Rural District Council under application reference KR 390/69. Albeit lawfully built with Planning Permission, the bungalow was never occupied, which raises a technicality in planning law, namely, a dwelling is not a dwelling until it is occupied. Under the auspices of a Chartered Planning Consultant, a Certificate of Lawfulness was therefore applied for to address this nuance. Wyre Forest District Council refused the CoL application under 24/0442/CLP on 27 September 2024. The main basis of the refusal was the view that the building had been ‘abandoned’. Notwithstanding this, it is factual to say that that the consent obtained under KR390/69 did not impose a time limit insofar as setting a date by which the building must commence. It is therefore our view that the existing bungalow has an extant consent. However this is a technical opinion not legally binding, and prospective purchasers should form their own judgements. We give no guarantee whatsoever and in the light of the recent refusal under WF 24/0442/CLP, a new detailed application will be needed.
